Terms of use for this website.

Short, because this site is short: it is a company website with no accounts, no sign-up, and nothing for sale. These terms set out the ground rules for reading it.

What these terms cover

These terms are an agreement between you and Nielsen Digital, LLC, a Texas limited liability company (“Nielsen Digital”), about your use of the website at nielsendigital.com and its pages.

They cover this website and nothing else. They do not govern MyDIYGarage, DriveWP, or any consulting or development work, each of which is subject to its own separate agreement.

Acceptance

Using this site means accepting these terms. If you do not accept them, please do not use the site. No account, click-through, or signature is involved — there is nothing here to sign up for.

This site is informational

Everything here describes what Nielsen Digital builds and how to get in touch. It is general information, not professional, technical, legal, or financial advice, and it is not an offer, a quote, or a commitment to provide any product or service.

No agreement for work is formed by reading this site or by emailing the address on it. Engagements are agreed separately and in writing.

Product descriptions, feature lists, and prices shown here are accurate as of the date above and may change. Where a product is described as built but not released — DriveWP — that is a statement of fact and not a promise of a future release, release date, or feature set.

Acceptable use

Read the site, link to it, quote it with attribution, and share it freely. Beyond that, please do not:

  • Use the site for any unlawful purpose, or in a way that breaks any applicable law.
  • Attempt to gain unauthorised access to the site, its hosting infrastructure, or any connected system.
  • Interfere with the site's availability, including by overwhelming it with automated requests.
  • Copy the site wholesale and present it as your own, or use its content in a way that implies an endorsement, partnership, or affiliation that does not exist.
  • Use the contact address for unsolicited bulk email, or scrape it for a marketing list.

Ordinary, well-behaved crawling and indexing is fine and welcome.

Content and intellectual property

The text, design, layout, and code of this site belong to Nielsen Digital, except where noted below. The names Nielsen Digital, MyDIYGarage, and DriveWP, and the associated logos, are the company's marks.

You may quote reasonable excerpts with attribution and a link, and you may link to any page here without asking. You may not reproduce the site as a whole, or use its content or marks in a way that suggests Nielsen Digital endorses or is affiliated with you.

Third-party components used to build the site remain the property of their authors and are used under their own licences — including the Inter typeface by Rasmus Andersson (SIL Open Font License 1.1) and the Phosphor icon set (MIT).

The products have their own terms

MyDIYGarage is a separate application on a separate domain, with its own accounts and stored data. Its use is governed by the terms and privacy policy published on that site, not by this page. If the two ever disagree about MyDIYGarage, the MyDIYGarage terms win.

DriveWP is not released and has no terms of service yet, because there is nothing to subscribe to.

This site links to sites Nielsen Digital does not control. Those links are provided for convenience and are not an endorsement. Nielsen Digital is not responsible for the content, accuracy, availability, or practices of any linked site, and your use of one is governed by that site's own terms.

No warranty

In plainer words: reasonable care is taken to keep this site accurate and available, but it is not guaranteed to be error-free, complete, current, uninterrupted, or free of anything harmful. Some jurisdictions do not allow certain warranties to be excluded, in which case the exclusions above apply only as far as the law allows.

Limitation of liability

Changes

These terms may be updated. The current version is always the one on this page, and the date at the top of it changes when the text does. Continuing to use the site after a change means accepting the updated terms. The site itself may also change or be withdrawn at any time.

Governing law

These terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules.

That applies to this website only. MyDIYGarage is agreed to separately on its own site, and its own terms say which law governs it and where a dispute over it belongs.
